Our Core Property Legal Services

We provide end-to-end support to protect you at every stage of your property investment journey.

Comprehensive Property Due Diligence

This is the most critical step before any purchase. We conduct a thorough investigation to verify the property’s legal status, including checking the land certificate with the National Land Agency (BPN), confirming ownership history, ensuring there are no active disputes, and verifying that the land zoning matches your intentions.

Purchase & Lease Agreement Drafting

A strong, clear contract is essential. We work with certified Notaries (PPAT) to draft and review legally sound agreements, whether it is a Sale and Purchase Agreement (AJB), a Leasehold Agreement (Sewa Menyewa), or another form of title transfer.

Secure Title Transfer & Certificate Management

We facilitate the entire process of transferring the property title into your name or entity. This includes managing the registration at the land office (BPN) and assisting with the issuance or updating of the official land certificate to reflect the new ownership.

Property Tax Compliance

We help you understand and comply with all required property taxes. This includes managing the payment of the Land and Building Acquisition Fee (BPHTB) at the time of purchase and ensuring compliance with the annual Land and Building Tax (PBB).

Building Permits: Understanding the Change from IMB to PBG

The regulations for building permits in Indonesia have changed significantly. It is vital to work with a team that understands the current laws.

Important Update: IMB is now PBG

As of 2021, the former Building Permit (IMB – Izin Mendirikan Bangunan) has been officially replaced by a new approval system called PBG (Persetujuan Bangunan Gedung). While many people still use the term “IMB,” the legal process and requirements are different. The PBG focuses on ensuring a building’s design meets all technical and safety standards before construction begins.

Our PBG (Building Approval) & Compliance Services

  • PBG Application Assistance: We manage the complete application process, from preparing the required architectural and structural documents to submitting them through the government’s online systems to secure your building approval.
  • SLF Issuance (Certificate of Proper Function): After your building is constructed, we assist in obtaining the Sertifikat Laik Fungsi (SLF). This certificate is now mandatory and certifies that your building has been constructed according to the approved PBG and is safe to use.
  • Compliance and Zoning Checks: Before any application, we ensure your building plans comply with Bali’s local zoning regulations (RTRW) to prevent costly delays and rejections.

Frequently Asked Questions (FAQ) for Property Investors

Can a foreigner own land in Bali?

Under Indonesian law, foreigners cannot own land with a Freehold Title (Hak Milik). However, foreigners can legally and securely control property through other means, such as a long-term Leasehold (Hak Sewa) or through a legal entity (PMA company) which can hold a Right to Build (HGB) or Right to Use (Hak Pakai) title.

An IMB was a permit to build, often applied for while the building process was ongoing. A PBG is an approval of the building’s technical design, which must be obtained before construction can legally start. The process is stricter and requires a final SLF certificate to legally occupy the building.

Due diligence is a deep investigation into a property’s legal history and status. It is essential in Bali to uncover potential problems like ownership disputes, incorrect zoning, or outstanding tax obligations that could make your investment worthless.

The main taxes are the Buyer’s Tax (BPHTB), which is 5% of the sale value, and the Seller’s Tax (PPH), which is 2.5%. You should also account for Notary (PPAT) fees for processing the transaction.
